Accommodation agreement


Article 1 Scope of Application

  1. Accommodation contracts and related contracts concluded between “Kyoya Daidai” (hereinafter referred to as “this facility”) and guests shall be in accordance with these terms and conditions. Anything not included in this accommodation agreement shall be governed by laws or common practice.
  2. If this facility accepts a special agreement within the scope of laws and customs, the special agreement shall take precedence regardless of the provisions of the preceding paragraph.

Article 2 Application for accommodation contract

  1. A person who intends to apply for an accommodation contract with this facility shall notify this facility of the following particulars:
    1. Name of guest, number of guests
    2. Date of stay (including estimated time of arrival in the case of check-in outside reception opening hours)
    3. Telephone number and e-mail address that can be contacted
    4. Other matters deemed necessary by this facility
  2. In the event that the guest requests, during the stay, to extend the stay beyond the date specified in Item 2 of the preceding paragraph, the facility will treat it as an application for a new accommodation contract at the time the request is made.

Article 3 Completion of accommodation contract, etc.

  1. The accommodation contract shall be concluded when the facility accepts the application as stipulated in the preceding article. However, this does not apply when it is proved that the facility did not accept it.
  2. When an accommodation contract for one night or more is concluded pursuant to the provisions of the preceding paragraph, the basic accommodation fee for the number of nights to be stayed shall be paid in full by the time of check-in.

Article 4 Refusal to conclude an accommodation contract

This facility may not accept the conclusion of an accommodation contract in the following cases.

  1. When the application for accommodation does not conform to these terms and conditions.
  2. When there is no room in the guest room due to full occupancy.
  3. When it is recognized that the person who intends to stay is likely to act against the provisions of laws and regulations, public order or good morals regarding accommodation.
  4. When the person who intends to stay is deemed to fall under any of the following (a) to (c).
    1. Organized crime groups designated in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Gang Members (Act No. 77 of 1991) (hereinafter referred to as “organized crime groups”), as stipulated in Article 2, Item 6 of the Act Gang members (hereinafter referred to as “gang members”), gang associate members, gang members, and other anti-social forces
    2. When an organized crime group or an organized crime group member is a corporation or other organization that controls business activities
    3. A corporation that has a member of an organized crime group among its officers
  5. When the person who intends to stay makes a violent request to this facility or the staff of this facility, or demands a burden exceeding the reasonable range.
  6. When it is clearly recognized that the person who intends to stay is infected with a type 1 to 3 infectious disease specified by the Ordinance of the Ministry of Health, Labor and Welfare.
  7. When accommodation cannot be provided due to natural disasters, facility failures, or other unavoidable reasons.
  8. When the person who intends to stay has behavior that causes significant inconvenience to other guests.
  9. When the person who intends to stay is staying only with under the age of 18.

Article 5 Right to cancel the contract of the guest

  1. The guest may cancel the accommodation contract by making a request to this facility.
  2. If the guest cancels the accommodation contract in whole or in part due to reasons for which the guest is responsible, the facility will charge a penalty as listed in the attached table.
  3. If the guest does not arrive by 6:00 p.m. on the accommodation date (if the estimated time of arrival is specified in advance, 2 hours after that time) without contacting the guest , the accommodation contract may be treated as being canceled by the guest.

Article 6 Right to cancel the contract of this facility

  1. This facility may cancel the accommodation contract in the following cases.
    1. When it is recognized that the guest may commit acts contrary to the provisions of laws and regulations, public order or good morals, or when it is recognized that the guest has committed such acts.
    2. When it is clearly recognized that the guest is infected with an infectious disease from category 1 to category 3 specified by the Ordinance of the Ministry of Health, Labor and Welfare.
    3. When the accommodation cannot be provided due to reasons caused by force majeure such as natural disasters.
    4. When the Guest is deemed to fall under any of the following (a) to (c).
      1. Organized crime groups, gang members, associate members of organized crime groups, persons related to organized crime groups, and other anti-social forces
      2. When an organized crime group or an organized crime group member is a corporation or other organization that controls business activities
      3. When a corporation has a member of an organized crime group among its officers
    5. When the Guest makes a violent demand against the Facility or its staff, or demands an unreasonable burden.
    6. When the guest makes noise, gets drunk, etc., and makes a significant nuisance to other guests.
    7. When the Guest commits an act that hinders fire prevention, such as smoking outside the rules established by the Facility, mischiefing firefighting equipment, etc.
    8. When a person other than the Contractor enters the guest room, regardless of whether it is temporary or not.
    9. When bringing or attempting to bring the following items into the facility:
      • Pistol
      • Swords
      • Items that emit a remarkably bad odor
      • Extremely large amount of goods
      • Items that are easily ignited or ignited (gunpowder or volatile oil)
      • Plants, animals, insects and other similar items
      • Other items whose possession is prohibited by law
    10. When the equipment or articles of the facility are taken out of the facility or moved to another place within the facility.
    11. When attempting to change, remodel, or modify the building or facilities.
    12. When distributing advertisements or goods, engaging in religious activities (proselytizing or soliciting), or engaging in sales activities to other guests, visitors or staff within the facility.
  2. When this facility cancels the accommodation contract based on the provisions of the preceding paragraph, the guest will not be charged for the accommodation services, etc. that have not yet been provided.

Article 7 Registration of accommodation

  1. The guest shall register the following particulars at the front desk of the hotel on the day of accommodation.
    1. Guest’s name, age, gender, address and occupation
    2. Nationality and passport number for foreigners
    3. Departure date and scheduled departure time
    4. Other matters deemed necessary by this facility
  2. When the Guest intends to pay the charges in Article 10 by means of accommodation coupons, credit cards, etc., which can be substituted for currency, he/she shall present them in advance at the time of registration in the preceding Paragraph.

Article 8 Guest room hours of use

The hours during which guests can use the guest rooms of this facility are as follows. However, if you stay consecutively, you can use it all day except for the day of arrival and departure.

Article 9 Observance of Usage Rules

Guests are required to comply with the usage rules established by this facility and posted within the hotel premises.

Article 10 Payment of fees

  1. The breakdown of the accommodation fee is as follows.
    • Accommodation fee
    • additional charge
    • tax
  2. The payment of the accommodation fee, etc. in the preceding paragraph will be made before the stay. However, if the payment is not confirmed, we may ask you to use Japanese currency, accommodation coupons, electronic money, credit cards, or other alternative methods when requested by this facility.
  3. Accommodation for the entire day even if the guest voluntarily does not stay after the facility has provided a guest room to the guest and it has become available for use, or if the guest voluntarily cancels the stay after using the guest room. A fee will be charged.

Article 11 Liability of this facility

  1. When this facility causes damage to the guest in fulfillment of the accommodation contract and related contracts, or in the non-fulfillment thereof, we will compensate for the damage. However, this does not apply if it is due to reasons not attributable to the facility.
  2. This facility is covered by liability insurance in order to deal with fires, etc.

Article 12 Handling when contracted guest rooms cannot be provided

When this facility is unable to provide the contracted guest room to the guest, the facility shall obtain the guest’s consent and arrange other accommodation facilities under the same conditions as much as possible.

Article 13 Handling of Deposited Items

In the event that items, cash, or valuables brought into the facility by the guest are lost, damaged, or otherwise damaged, if the damage is caused intentionally or by gross negligence on the part of the facility, the Compensate for damages. However, with regard to cash and valuables, if the facility requests a declaration of the type and value of the item and the guest fails to do so, the facility will not be liable for damages up to 50,000 yen.

Article 14 Storage of Guest’s Baggage or Belongings

  1. We do not store your luggage or valuables at our facility. Please keep it by yourself.
  2. If a guest’s luggage or belongings are left behind at the property after the guest has checked out, the property will contact the owner and ask for instructions once the owner is identified. However, if there is no instruction from the owner or if the owner cannot be identified, as a general rule, we will keep it for 7 days including the date of discovery and deliver it to the nearest police station.
  3. In the case of paragraph 2 above, the facility’s liability for the storage of the guest’s baggage or belongings shall comply with the provisions of Article 13 in the case of paragraph 1. In the case of paragraph 2, the provisions of paragraph 2 apply.

Article 15 Responsibilities of Guests

  1. If the facility suffers damage due to the guest’s intention or negligence, the guest will be required to compensate the facility for the damage.
  2. The facility will not compensate for any damages caused by the guest not following the instructions, guidance, notices, evacuation guidance, guidance, etc. of the staff of the facility.

Article 16 Disclaimer

Customers are responsible for their own use of computer communications from within the facility. The facility will not be held responsible for any damages incurred by the user as a result of service interruption due to system failure or other reasons while using computer communication. In addition, if the facility or a third party suffers damage due to an act that the facility deems inappropriate for the use of computer communication, the guest will be required to compensate for the damage.

Supplementary provision

This accommodation agreement shall apply from December 1, 2021 (hereinafter referred to as the “application start date”).

However, for accommodation contracts that have already been concluded by the day before the application start date, the old accommodation agreement and usage rules shall apply.
